I believe Pinkie Pie said she's a fourth cousin twice removed in the episode; this would mean that she and Applejack share a great-great-great-grandparent with a two-generation shift for one of them. According to my rudimentary knowledge of genealogy, that's either ten or six hops away, leading to either 0.0488281% or 1.5625% genetic relation. I'd hardly call that incest.

4535691 Yeah, it's weird but the justice system believes it's no big deal as long as they're not directly related to you such as daughter/son of your aunt/uncle, or sister/brother. I highly doubt this but they believe the genes past 1st cousin is so mixed up that it wouldn't affect the baby. I'm no expert in genealogy but I'm not sure that's how it works.
