So Sunset is getting off because Tonya is so dumb that she is taking the fallout. Even though the murder would have happened anyway without mind control due to sunset.

I don't think that Sunset is really in line to just get off on it. I think she is just hyper focused on the fact that Tonya is in danger from this that she doesn't care about the personal danger to herself. The legal issues she dismissed as not the problem to concern herself about at the moment, she's concerned about a possible death sentence coming down on Tonya from Phobia. What Sunset did had no bearing on what Tonya did in terms of the Dreamwardens since Sunset can't use mind magic therefore they aren't going to pull her to trial.
I'm not sure what she's onto, but now that I'm reading it I think she's right. Something's off about the Number Crunch thing if Number rages at Tonya but not at Sunset about what happened. I have a feeling Sunset's going to find a loophole to get Tonya out of this somehow.

None of the Dream Warden's will want to antagonize Phobia on this issue, since they will have to work closely with her for who knows how many centuries. So they will all have a strong motive to find some excuse not to punish Tonya so harshly that Phobia holds a grudge over it. They just need to find an explanation for their judgement that at least sounds plausible.
The question I find interesting is if this will have any effect on Shadow Dancer's trial. The two cases are sufficiently different that they could theoretically treat the two defendants very differently, but they also want to avoid the perception that they are being biased in Tonya's favor because she is Phobia's best friend. The more lenient they are in Shadow Dancer's case, the easier it will be for them to justify an even greater degree of mercy in Tonya's case.
At the very least, Shadow Dancer deserves a better defence lawyer than Crystal Dreams, who has no idea what is even going on, and who is facing as Prosecutor the future wife of one of the judges. I'm hoping Wild Growth and Number Crunch can become Shadow's defence lawyers.

No she won't, because Tattered Wing has been ordered by the US government back in Chapter 8 to cover up Sunset Blessing's role in this killing. So Tattered Wing couldn't arrest Tonya if she wanted to, because Tonya is just too close to Sunset Blessing. She might be able to arrest Number Crunch, but she won't because the use of mind control means Number is really not clearly guilty.

Further, advertising that ponies can use mind control is not something anypony wants to do, lest it gives humans another reason to be leery of them.
You honestly can't blame the Dreamwardens coming down hard on misusing mind magic, if there was no oversight it's highly likely that eventually the night ponies might face a campaign of extermination to remove their threat. A really good case can be made that all ponies afflicted by the vision have been targets of such mind magic and it's heavily warped some ponies into being very different from how they were before. That cannot be ignored. It's only their word that it doesn't affect humans, and we know that in some cases, it does.
It's interesting to consider the can of worms that Sunset Shimmer was opening up here. Let's say that everything went her way, the entire world was converted, and she became an immortal alicorn. Do you think the Dream Wardens would have popped up anyway and destroyed her? I find it highly likely. Makes one wonder what the heck Nightmare Moon was.
