Horses are horses, and the law is the law, and there aren't any exceptions in the law for sentient horses. So, until someone got around for adding them, Mz. Dash would just be another performing animal, like a magicians rabbit. (Which are definitely under the jurisdiction of the USDA, just look at any magician's web forum)
