Snowbright definitely killed Hotpot for personal reasons as his reasoning for not killing the other soldiers was that they were following orders. Hotpot was also following orders to spy on them so since she can be executed so can the others. Twilight needs to establish that she is in charge before Snowbright tries to take leadership of the rebellion for himself.
Also they did not bring up the economics of the death penalty. It requires resources such as room, food, and medical to imprison ponies.
Great story that I believe deserves more likes.

Schisms like that aren't uncommon. Successful insurgent commanders have a lot of public goodwill, particularly when there isn't a government to fall back on. Like now. This is why so many young governments fall apart and the militaries step in, to win a rebellion the military has to work. Government doesn't.
Twilight might really need to start establishing a government and arresting the power of the military if she doesn't want Snowbright gaining to much influence.
If Hotpot had more value it could have been argued to hold her for trade in the future, but with no reason to believe that would ever be a possibility...
I would have done everything I could to divorce the death penalty argument from Hotpots punishment. Even if it meant executing her beforehoof. Passions were too high for a decent debate on the topic. Personally, I think the death penalty should be used, but only in cases of overwhelming evidence. What happened was less democracy than mob rule.
Finally, the True Believers of the Lady. Twi, do something about this. Support it, crush it. Just don't leave it dangling for a certain crazy Fausticorn to pick up and throw against the world. Ponies want to believe in something in rough times for support, that's natural. But get over the embarrassment and do something about it. Tell them that her suffering in the Dukes Castles has driven her to madness and filiacide (she wants to kill her daughters) task them with helping calm her and focus them to repairing the wounds the Duke has left on everypony in the Country. If you have to face a zealot army when she gets out and goes on a rampage so help me.

The scary part? Now the rebellion leadership is less interested in leading the rebellion. Snowbright and Daybreak may actually have to step up onto leadership roles there not capable of if Twilight and friends step back in disgust at there actions.

Twi's the student of her "polluted" daughter Celestia. Thus she was going to be culled anyway when Faust learned of it. I'm hoping Princess Friendship and Princess Woobie can manage to blunt the disaster in waiting that is that Alicorn.
Those she does need to do something about the Followers of the Lady, I don't see them as evil, but something that could be turned to it if Twi and Co aren't careful. They are a big pile of possibility that worries me.
I can't think of a government that, in a time of war, doesn't execute spies. In peace they end up in prison for near life terms. I'd have fought to keep Hotpot and the death penalty separate ideas if I was a purple alicorn. Tried to put off the case, pass it to the court system (Spike, take a note: establish a court system) or take the loss and allow the execution. Then debate the point when egos and emotions weren't on the line. Bookhorse got played.

7594960 Didn't think Fausticorn would get this much discussion when she wasn't even directly mentioned, but oh well. Time for me to weigh in my two cents. (Cents of any kind not being valid currency in Blighty, so are therefore worthless.)
Option 1: Deny the existence of the Lady/ Faust. Even if the Lady's followers were to believe that, which likely they wouldn't, as soon as Faust came into the picture they'd accuse Twilight of being a big heretical liar liar pants on fire, and all the madness that would follow.
Option 2: Tell them about Faust and how batshit crazy she is. Opens the possibility of believers going 'this is the lady! She couldn't possibly be wrong!' Put Faust on pedestal from which she can do so much damage. Believers do have a tendency to be blinded by their own beliefs, and would likely believe Faust over anyone else, along with all the new converts because OMG the lady was real all along. Again, bad things could happen.
Option 3: The Celestia solution. Or as Celestia would call it, the Twilight solution. In other words, delegate it so hard it bounces. Pass the problem off to Celestia and Luna to solve and hope they know best. At the very least they could find her a nice cosy cell in the SCP labs.
Also, don't forget that Twilight left Faust locked up. Faust already has enough of a grudge for that without Twilight being the tainted student of her tainted daughter. Twilight has no reason to believe anything involving Faust would end up going well for her.

Ah, the joys of orthodoxy. I'm right because I believe harder. I can't think of many more bitter feuds than the arguements in early Christianity over minor points of doctrine. The only thing going in Twilights favor was their trust in her as an alicorn. Personally I think approaching the ladies followers might at least split them into two groups, some that believe Twilights story, help save (physically and mentally) the Lady, and old believers who will follow Faust regardless. At least she could identify problem ponues now before they flock to Fausts banner. My 2 cents.
Also, not sure if I trust your list. Authors love messing with readers and leaving out what'll really happen. Id bet none of the above are planned.
We know so little about the followers of the Lady, other than their mass appeal. Did they vote against the death penalty due to their beliefs or because Twilight wanted that and she's an alicorn? What are their values? Twi does have a lot of pull with them, I'm not saying she should say "yes, I am the Ladies will made flesh" but "I am a knowledgeable pony who cares for the spiritual health of your people." A group of religious fanatics with an army of the faithful is much more dangerous than a group looking to act as caregivers and doing good works to spread freedom and prosperity. But then this isn't a world I know, Hand is the authority on them. Whatever happens it will be interesting.

I myself have no desire for the death penalty. But, I believe that they do have a role in the current society. Though, not to be used flippantly. This form of execution is reserved for the worst of the worst. Like war criminals and tyrants. Though, if it's possible I would like the death penalty to be abolished. But, that idea hangs on to the notion that everyone is once pure and therefore redeemable. While that is true, the way they grow snuffed out the possibility of their innocence, especially if they have no remorse. You can reform 95% of the prisoners in the prisons to be working members of society. But there will be that 5% that wouldn't see that way and in those 5% the death penalty will only be applied to those who are war criminals, serial killers, rapists and murderers and in those only the remorseless and the ones with no desire to change can—can, not will, mind you—be tried for the death penalty.
In this case, I would oppose the death penalty. Particularly because this is important to reform the Mareitanian society. To show that there are other methods than the death penalty. To show that the justice system is not built to go forward with someone's vengeful desires, rather to serve justice, punishment that is equal to their crime which in this case, espionage and treachery and in my opinion, incarceration is enough.
Also, Snowbright has to be stopped, someone has to let him know of his place. What he's doing can decide the new mentality that Twilight's new Mareitanian society is forming. He's advocating for the worst form of democracy. Populism. Power that is while, to the people and of the people but not for the people. While those who advocated for this thought believes that everyone's voices is heard, it's not heard by all and considered rationally, only to cater to the majority, this only benefit those at the top and this alienates the minority rather than working with them. This can breed extreme and radical ideas, ideas that correlate with mob rule and the feelings of the masses, like fear and hate. Easily manipulated. There are examples to this, it is how the democratic countries like Germany fell to Nazism and a democratic Japan fell to ultranationalists both in the 1930s. Both radicalised the populations and they believed them. Even if the majority believed it was right, it is not. That's why the minority exist, that’s why the opposition exist to challenge that and to work with the majority to find the right way.
