Being the very first sentence of this chapter, I'd recommend changing "he" to "Silver."
Not an error, but...this sounds slightly different from how I thought it went. I thought that the first wife made the choice, and the stallion ratified it or vetoed it. This makes it sound like Night Watch has sole decision-making power in that regard, and is daring Silver to dissent.

Well, now my pontificating about why Pinkie being an "honorary" herd member was a bad idea seems rather pointless.
That said, I feel that the entire "herd" concept is rapidly becoming diluted to the point of meaninglessness. It's happened so often, and has become all but routine, that it's losing its significance. To be fair, Twilight's declaration of what Pinkie meant to her had emotional impact, but it feels like it was more a general statement of "I love you," without the meaning that this was a marriage. Given that neither mare seems to want to have sex with each other, and Pinkie will maintain her separate residence, the entire thing seems like little more than a formality.
By the by, did anyone notice that Silver's conditional approval would mean that, if Pinkie doesn't successfully carry the foal to term, then she'd no longer be a part of the herd? I seriously don't think that he meant it that way, but that's how it could be taken.
Shifting gears, I groaned at the part where Silver and Twilight began discussing randomized control trials with regard to Pinkie's "pinkie sense," because while that is the gold standard for clinical trials, that's a separate issue from Twilight's studies on the issue that she conducted in the show. As was noted in this chapter, a randomized control trial would be done to determine whether or not a "pinkie sense" was evident in the (earth) pony population at large...which is kind of moot, since it's self-evident that that particular ability is unique to Pinkie to begin with. Admittedly, conducting such a trial would be the most scientific way to confirm that, but that was never the point of Twilight's investigation; her investigation was to try and figure out what the "pinkie sense" actually was. In that regard, she did everything right - the first thing you do when trying to define an unknown phenomenon is attempt to measure it using various metrics. The fact that she failed doesn't mean that her methodology was wrong.
Beyond all of that, Silver's speech about how he felt as a mare when Twilight was topping him was surprisingly heavy; I'm rather amazed that Twilight wasn't beet-red after that. Still, the question seemed like an odd one for Twilight to ask. Maybe it's my own presumption here, but I've long been under the presumption that it was Silver's alicorn status that was causing his fertility problems. After all, prior to that he had no problems either siring or conceiving foals (as Night Watch and Twilight can attest), and there's already confirmation from Celestia and Luna, so that seems like a pretty strong hypothesis. It's not necessarily wrong to cast a wider net, but it seems like starting from the least likely possibility first.
Ah well, another day another herd member, all while poor Tumble hasn't even gotten a date yet!

That said, I still don't see any particular impetus to test other ponies to see if they have that particular ability, since it's usually self-evident. I agree with Twilight (from the show) that trying to measure what it actually is and how it works is more important, and that doesn't require a randomized or blind trial.
EDIT: Particularly since the two don't even seem to do the same thing. As I recall, Pinkie's "pinkie sense" warned her of impending danger. Cheese Sandwich's "cheesy sense" pointed him towards a town that was having a party. Which sort of does make Pinkie's ability unique...kind of.
