Okay, this is an interesting turn of events. Magic does exist on Earth (and yes, you mentioned it in previous chapters), but it's of a more complex nature than Equestria's. Also, Twilight was... well, perhaps not pardoned, but certainly too useful to throw into a jail cell. Do her parents or (adopted) brother know she's still alive? Do they know where she is?
I'm guessing the secrets of Earth's magic has something to do with why Celestia chose Earth as her destination (at this point, I'm thinking this story is an offshoot of the Negotiations-verse than a full what-if). Should be interesting to follow.
The reason I say this story is an offshoot rather than a full what-if is because in Fallen, the humans haven't made landings yet when Celestia tried her ritual, but here, it seems the initial invasion of Equestria was fully underway when Celestia was trying to use the Elements of Harmony and received brutal judgement instead. Suture String mentions losing her home in Baltimare to war when the humans made their invasion (or was it because it got bombed prior to the landings?).
A few minor notes on previous chapters: In "Garden of Pomegrenates", Applejack is still holding on to a lot of the old pride; yes, it's because it's all she has left, but it also means she's still got an inflated ego. She actually believes anyone trying to arrest her would bring in the goddamn cavalry and fleet of police cars. While she was an Element of Harmony and did support the war, she never actually did anything to UN forces or to humans; all her actions were focused on 'traitors' and dissidents. All they'd need to arrest her is a couple of patrol cars and a couple guys with handcuffs, and even then, it's not like she's wanted for crimes against humans. If anything, it's the new Equestrian government (or whatever passes for it) that would want her extradited because of her collaboration with the old regime to imprison dissidents and opposition to Celestia's rule.
Speaking of Applejack, how's Applebloom holding up? I'm guessing unless the Wonderbolts got sent to the coast to die as they did in canon, Scootaloo is still alive, so she'd at least be able to keep her company. Also, was that about Big Mac hating Applejack a typo, considering that in canon, he died in the third year of the war? Or was it about how if he were alive, he'd despise what she did?
In "Sefer Ha Lavanah", Luna still seems to be trying to impose her judgement, though more out of habit than any genuine belief in her superiority, especially given how she's been damned as a result of her actions. I mean, the head of PER Haifa is a hypocritical slimebag, sure, but he wouldn't have done what he did had not Luna and Celestia encouraged him to do it. She's angry and bitter she had to face damnation while others walked away scot-off, but it's not like she hadn't helped enable his actions. Hopefully, Rabbi Nahum will help her face her past constructively and maybe even finally atone.

Anyways the Baltimare thing happened mostly due to the fact that quite a few cities didn't surrender, and the human forces were basically waiting to pounce the minute the barrier was down. The military presence as of this chapter is for the most part more of an occupation a-la post war Japan or Iraq.
I have the feeling Earth magic is more Dresden Files or Hellblazer than ponyland. No wonder most humans tried really, really hard not to notice it. At least until the Fire Pony Nation attacked .
Apple Bloom and and Scoots seem to be just fine. Problem is neither is happy right now with their big sisters, specially AB. Understandable given Applejack burned down all the goodwill the Apple family had earned from Ponyville for generations.
Twilight felt her heart stop. It was no longer a matter of whether Celestia was controlling them but rather how much? How much of Equestria's blind devotion was a milder form of the same brainwashing used on the New Foals? Was the restraint a matter of ability, or a matter of principles on the part of Celestia? More importantly was Celestia being controlled herself?
(Shivers) Cannot help but remember this scene from Choices, chapter 14 (Decision).
"Pony potential?" Celestia raised an eyebrow and flared her wings "What more could we possibly achieve? We are the very zenith of what is possible in life!"
