It saddens me to say that the cops actions, if I had to guess, are perfectly legal.

Since the guy refused to hand over the container, the cop would have been unable to identify the actual contents of the beverage (the original contents of the can could have been replaced).

"Land of the free" - The place where you can't walk around the middle of the street drinking beer (and after a quick search it seems like it is actually quite common in other countries). Its things like this that sometimes make me want to jump on the libertarian bandwagon
