A Quick Question · 1:01pm Jun 15th, 2013
On PMV's on the Internet... how do they get away with putting song's that they haven't created onto the videos? Surely not all of them could have gone to ask for permission to use them?
And most importantly if the company discover they have done it I'm assuming they can't sue them for promoting their product in a roundabout way (especially if they put in the description that they don't own it, and put down the company that do)? They can just ask YouTube to pull the video down right? Or mute it?
Sorry about asking all this, but my conscience won't let me clear doubt on the PMV's me and Sour are making-- So, does anybody know?
Please... help...
(P.S. I'll be back on fully on Monday after my last exam. I am so Nervoucited!)
Really, truly, most just throw the music and images in without asking permission, throwing up an appropriate copyright notice.
If hosted on YouTube, the copyright holder(s) can asked it to be removed (and YouTube will comply), but unless that copyright holder happens to be e United States government, that's probably the worst that will happen.
If the circumstances are right, you might be able to argue "fair use," in which case no one can do anything to stop you, but even if that were the case (which is not likely), that's some shaky ground to be on.
In any case, they are unlikely to sue: Lawsuits are very expensive things, even when victory is assured, and especially when the desired result can be achieved with a simple writ telling the offending parties to cease & desist.
Hope that helps.
