I caught some flack for saying
"In the USA, you can't get a LIBRARY CARD without a background check but in Arizona you can buy a LETHAL WEAPON without one.". So, I'm going to vent.
OK, for non USA readers
There are Federal laws which apply across the USA.
There are also 50 states, each of which can have its own laws, as long as they don't contradict Federal laws.
There can be substantial differences between one state and another.
First, the "background check for a library card" statement.
You apply for a library card, they
1) Make you show a valid ID. They check it's not faked & you live in the city.
2) They check if you owe the city money.
Someone (I believe from the Ukraine from their user name) denied that was a background check.
Granted, it is FAR from the most rigorous background check God ever let loose on humanity but if that's NOT a background check, then what would you call it? They have yet to reply.
Now, Federal law requires a LICENSED dealer to do a background check. One for each gun sold. You buy 4, they have to run 4 checks on you. However, in Arizona an UNLICENSED dealer does NOT. Plus, if the federal government doesn't respond in 3 days they can still sell to you. How is that different from "No background check"?
There is no law on "How many guns can you sell before you have to be a licensed dealer?". There is also no law about "What is the maximum % of your income that can come from gun sales before you have to become a licensed gun dealer?". IIRC, there used to be but the NRA killed it.
So, you sell 500+ guns a day and earn 100% of your income from gun sales? You still don't need a license. Technically, only licensed gun dealers can sell to out of state residents. Otherwise, there is no need to get a license.
At gun shows, you see booths advertising "No background checks". Federal law says the sponsors "may" require background checks. "May" =/= "must".
Federal law says "You must be 21 to buy a handgun.". + Several restrictions on buying rifles or shotguns if you are under 18 & you can't buy under 14.
However, there are very few BATF agents auditing unlicensed dealers so IDK how strict they are checking IDs to see if you are underage.
In Arizona, you don't need a license to carry a gun nor do you need a license to carry concealed. (Unless you look like a minority. Then, you might have problems.)
The state of Arizona does issue gun licenses. The state specifically says they do it to help residents gut licensed in stricter states.
In a recent SCOTUS decision (the Bruen case), SCOTUS specifically called the part of the Second Amendment about militias to be "preliminary" & decided that it doesn't count.
Technically, this means ALL Federal & state gun laws are abolished.
