Which government? The dreamrealm is by any account its own territory that can't be policed by any human, and setting up a system with any individual government has said government hold sway over all night ponies, regardless of nationality.
I didn't really like Phobia's apparent assumption that Shadow Dancer is so obviously guilty and that her sole responsibility as his judge is to impose a sufficiently horrific sentence to terrify millions of night ponies. Perhaps this is what happens when you hand overwhelming judicial authority to an average high school graduate with no serious ambitions who a month ago was stocking shelves in a convenience store.
One of the reasons I hoped Wild Growth might get involved in Shadow Dancer's defence was because she at least knows that there are plenty of reasons why some humans would want to become ponies. Every one of the human members of her family has some reason to wish they were ponies, so she might at least have wondered how many of the humans Shadow Dancer supposedly persuaded already had significant reasons to wish for a major change in their lives.
I hope that some character in this story is at least trying to gather some real evidence about exactly what Shadow Dancer did or didn't do, but the extremely short time Phobia has allowed for any investigation, combined with the fact that night ponies (including Shadow Dancer himself) can't get into the dreams of the humans Shadow Dancer is suspected of manipulating makes me doubt any of these issues will be adequately addressed at the trial. Shadow Dancer will probably be asked at the trial exactly what he did to those supposed 5000 human recruits, but so far, we don't have any real reason to believe that even Shadow Dancer himself has enough knowledge of magical mind control to really be sure how much, or how permanently, he actually altered most of those humans.

As I’ve stated in previous discussions about this, you could set up a system similar to the UN to deal with the Dream Realm. Each nation would contribute ‘votes’ towards candidates to become Dreamwardens. I have a lot more detail if you read previous comments about it, but that’s the jist.

I know, I read it, but it doesn't really work because A: Dreamwardens are needed now rather than a decade down the line in order to prevent the wrong kind of night ponies from creating a reason for humans to start a night pony genocide, and B: Dreamwardens are a job for life. A very, very long life.
It also puts humans firmly in charge of something they cannot possibly understand fully, which is going to create an endless loop of misunderstandings and frustrations with a high chance of escalation eventually.

First of all, this could be implemented within a year or two, and the current system could be used until then.
Second of all, like I said in previous comments, you can assign Dreamwardens for, say, ‘life or 50 years’, whichever comes second, and then they go into the Eternal Dream. Nothing forces them to go thousands of years without switching.
Third of all, why exactly does this put things into humans’ hands entirely? The effects of the Dream Realm concern all living beings, not just night ponies, or even just ponies. Humans can be brainwashed too, their friends can suffer judgement, etc. The system should be in the hands of all sentient beings, not merely the sentient beings privlaged enough to be able to actively affect the Dream Realm. And it’s not like putting it in government hands is going to force ponies out- I envision a more connected future between humans and ponies, not a separation.

But why replace them at all if they're still up for the job? They have oaths to keep them in check and they show signs of at least being willing to consider working with earthly authorities (Phobia anyway). I had wondered why they'd decide to come out after they start dying assuming Sha'am's death is what they are waiting for. It occurred to me that is when they become less aware of what's going on in the waking world. They can hope that the night ponies will rat out ponies that are misusing mind magic, but it's easier if they have a standing agreement with the world's governments for the government to just tell them.
The eternal dream is essentially a suicide. Yes they are technically still alive, but they're cut off from everything. Asking people to regularly commit suicide is hardly a good alternative.

Two years? Maybe if the voting is only in America, but this would be a global initiative. Negotiations between individual nations can take several years, even decades, and in this case we're looking at getting every single nation in the world to agree on something. Not to mention that such negotiations are impossible to hide from the public, which will cause a panic and extreme paranoia towards night ponies with a rather high potential for fatal results.
As for term limits... you do realize this means essentially putting term limits on a pony's life, right? The Eternal Dream is the equivalent of an afterlife for Dreamwardens, since they're immortal. To say "you've got the job for 50 years then go to the Eternal Dream" is essentially saying that's the time they have left to live. Not something I can see night ponies taking to easily, especially when told by humans. And it will be humans in the government for the forseeable future, the current political climate doesn't really let a lot of ponies in high positions. Even FBI officers have been shown to be refused their former posts back. Which means the groundwork of the system itself will be designed by humans.
