Oh thank goodness you're here! When clopfic.heroku broke down, I thought I'd never see this again. Thank you for migrating over here, this was one of my favourites. What the hell happened to that site? It just suddenly seemed to stop as if frozen in time, and after checking it recently it claims to not exist.
I've been waiting for this, and it makes me far happier than I should be.

You realize that Pen Stroke has asked for people not to use Nyx in clop-fics, particularly foal-con, right? (I haven't read it, so for all I know she's aged in this, but still.) Did you get permission from Pen Stroke to write this?

2467138 ... Yeah, you do. Nyx belongs to Pen Stroke. He has made several blogs about when you can and can't use Nyx, and foalcon/smut is one of the cases you can't use her. (At least, not without talking to him in detail about what, why, etc.)
Just because she's an OC doesn't mean you don't have to get permission. If you think about it, every character created in a show, book, etc, are OCs. All it stands for is Original Character. You can't just go write a book about, say, Eragon and publish it without being sued out the * for using Paolini's character. It's the same thing here, just with less suing and whatnot.

Past Sins fans would beg to differ. You shouldn't use someone else's character without their permission. True, nobody can stop you from doing it still, but hey, guess what? It is common decency to ask the original author first and to respect his wishes. And this is coming from someone who isn't even a Past Sins fan.

Good to see you don't even have a shred of common decency. The least he could have done is simply asked Penstroke, just like people ask if they can use artwork from Deviantart and the like. This is really no different. If the original author of Nyx doesn't want his character to be used for this kind of stuff, the least you could do is respect that. If you want an alicorn foal having sex, make up your own OC. And before you say "Oh, and I suppose you asked Hasbro for MLP fanfic permission, hmm?" No, but we have it. If we didn't, there wouldn't be this site. And if you think everyone allows fanfiction, think again. Robin Hobb for example doesn't, and so the major fanfic sites don't allow fanfiction of her work. Hasbro has not made any statement about fanfiction (yet), so we are free to use it until they say otherwise. The day they say they don't want fanfiction anymore is the day this site shuts down. Likewise, Nyx isn't yours, and the least you could do is ask. That you don't even have this bit of common decency shows how much you "respect" the author of the original story. But hey, I expected no less of bronies.

2467253 Yeah... Brush up on your law. A character is only a trademark if they're associated with a PRODUCT, just as Ronald McDonald of McDonald's restaurant chain, or Sonny from Cocoa Puffs. When it's a literary work, then a character would be copyrighted due to the work (the book, or in this instance, a fanfiction) being copyrighted.

The copyright still applies to concrete works: a paragraph of description, a specific picture, a particular set of events. The abstract concept of literary character is not covered by copyright. I could write a fanfic about Gimli and Legolas and the Tolkien Estate would be quite powerless to stop me unless I'd stick them directly into timeline of LOTR and not, e.g. put them after the events - storyline as such can be copyrighted.
OTOH, Peter Jackson could stop me due to massive amount of merchandize featuring these characters.

I should have guessed fans of Past Sins would be as vacuous and detestable as the story itself.
I remember this story. I remember enjoying it as a work of parody, and I wish more would be written. If you don't like that, you can feel free to go away. But acting like you can use legal force to get rid of a fanfic because it contains things the author of an OC doesn't agree with is about as scummy as it gets.
All fanfic has the right to exist, and to spit on the very principle that allows anyone to write fanfiction at all shows your hypocritical, crass nature. I sincerely hope you leave this website and never return.

I liked Past Sins. Not as much as some people, but Nyx was adorable where it counted and the writing was pretty solid. However, I see nothing wrong with being amused by this. It's not like she's a real... Ah. I forgot that there are some people who actually do consider these pastel ponies 'real'. Oops.

Just can't stop sniggering over this. And yeah, the instant you write unauthorized fanfiction, you lose pretty much any moral high ground regarding fair use. This is akin to the millions of recolored Sanic images on DeviantArt captioned, "Original character: do not steal!"
I'm all for appreciation for hard work. I enjoyed Past Sins quite a bit, despite the colossal Mary-Sueity. Doing something silly like dictating how and in what context a derivative-of-a-derivative character "may" be used is just along for it, though. Getting butthurt over the unauthorized derivative of somebody else's unauthorized derivative fan character that you're simply a fan of is kinda... Aspergy. If this is you, you would be well served by taking a step back to reexamine your priorities. A MLP OC fanfic shitfit is probably not the healthiest use of your emotional investments.
