... this might be the time to bump this again.
Hoardsmiths by Skywriter
I highly recommend it, and I recommend sharing it with people who become upset about things like the JanAnimations C&D.
Not you too, Book.

I honestly don't care about it (nor did I care about the Fighting is Magic C&D, which was what this fic was written for.)
I just agree with the fic. We're all insane, and if people think that anything we do for pony isn't a potential thorn in Hasbro's side, they're extra insane.
(This is also why I'm always against physically publishing and selling fanfic, no matter how little money the author is making.)

I meant more along the line of buying that the C&D was real. There's a lot about it that's really fishy.
1946165
Like I said, that doesn't really matter. What matters is that people are upset about it, as if the idea that Hasbro could C&D each and every one of us is totally unfair.
I just want people to understand what we are doing here (and in other parts of fandom.)

What about it is fishy? Jan said on his tumblr that he got in direct contact with Hasbro's legal department and they confirmed it was them who sent the C&D.

Mmm, I gotcha. I misunderstood what you were saying there, my bad.
As for the thorn in Hasbro's side comment earlier, not sure if I agree. The only reason the show has hit 3+ seasons at the moment is because the fandom is going crazy with new goods and services. It's like zero cost advertisement for 'em, I know they wouldn't be selling half the
plushesplushiestoys they do now. I doubt they'd have a trading card game if it weren't for the voracious more adult fans, nor would there be conventions. The fandom prints money for them, so they deserve at least a little respect, even if there is an inordinate amount of weird ass things being sold and produced. T-though I do agree with you on selling fanfiction, that's just silly. At least word swap some names and the like, sell it as OC and hope it prints money.Edit:

That's an impressive amount of apathy from Hasbro then. No watermark, no private e-mail address, misspellings, it sounds like nitpicks, I know, but all that would make a man question the legitimacy of the letter. Disregarding it would have been a viable option for the guy due to its less than seller presentation.
Yes! I was trying to remember who wrote that. Thank you!
Also, Hasbro VP of something or other says he's looking into the issue. So, yay, I guess? Mike Vogel Tweet

That's why I said our fanworks are a potential thorn in their side. (Edit: Or maybe I didn't. That's what I meant by "do for pony"-- things we actively do in honor of the show.)
While all of that is true, and I'm sure they appreciate the fandom, anything that gets too big, or too close to something they want to do, even by accident, runs the risk of being a problem that they'll stomp on. The Fighting is Magic crew (as I understand it) had no intention of the game getting as big as it did, or winning awards at conventions... but when that happened they were a potential problem and needed to be stomped out.
If the New York Times Lit review did an article on Fallout: Equestria, you bet that Hasbro would come down like a ton of bricks, even if no one from the fanfic community had anything to do with it.
Now, filing off serial numbers and publishing stuff as original is totally different. That's a time honored tradition dating back to Shakespeare, so why wouldn't we, uh, creative types keep it up?

Hell yeah, buddy.

It almost certainly has a private email address in the blacked out section at the bottom, if not an actual, physical address (I would guess it likely has both).
The misspelling of Scootaloo's name was probably a typo rather than an actual misspelling, but it is worth noting that lawyers are far from perfect and Scootaloo is not going to be in any standard dictionary; one would think that they would make sure that they got that part right, but I've seen misspellings in judicial decisions before, so I wouldn't be terribly surprised if a lawyer screwed up a C&D.
I also am unsure of how they could watermark a message they sent in the manner that they did.
Ignoring a legal notice can be very dangerous, as it can result in default judgments against you in some cases. Ignoring a C&D like that, for instance, might drive them to escalate the situation, which you really don't want, especially given that it was quite polite and they didn't even threaten to follow up with further legal action, which is pretty common in many C&Ds.

Thought I'd share with the class; I found this more amusing than I should have.
It's an interesting paradox: the better and more sophisticated a fan work is, the more likely it is to attract a C&D. It's the same thing that happened with Mane6: if they hadn't done such a damn good job, they never would have found themselves in Hasbro's crosshairs.
Of course, that same skill and dedication is what got them their current partnership with Lauren Faust. I very much hope that a similar opportunity presents itself to Jan.
Getting a Cease and Desist is starting to become a badge of honor in this fandom. Congratulations, you did so well that a multi-billion dollar company decided you could potentially threaten their IP. If I was Jan, I'd put that on my resume.
Huh.
Well that's depressing. Gotta move on tho.
Hey, thanks for the crosslink, Bookplayer! I love me the good kind of attention.

No problem. Thank you, for writing one of the most lovely allegories for a common fandom occurrence that I've ever read.
