Update to the Legal Side.
Bad, bad news. The other guy's insurance is denying the claim, stating that there's no proof their insured was driving the vehicle.
My attorney has assured me there are a bevy of options, but this is still bad news as it makes the case much more difficult, and thus, highly consumptive of both money and time.
Our options:
1) Send another letter of demand, reminding everyone that, as it was a fast-food drive-thru, it is highly likely there is video footage. If that is the case, and the driver is insisting it was not him, but it was, point out that it opens him to criminal charges beyond a simple hit-and-run.
2) Sue the driver for the name of the 'ghost driver'. If he does not cooperate, criminal charges of obstruction. If he does cooperate, and he was not the actual driver, open a claim and send a demand to the -new- insurance company.
3) Sue the insurance company that is denying the claim in an open lawsuit, on the basis that it is still their responsibility, as they insured the vehicle that was used in the crime, and they are, as such, partially responsible for obstruction in this instance if they fail to comply. This will extend the case out to months if not years.
4) Sue my insurance company for my uninsured motorist coverage.
So...yeah. I'm hoping for number 1, and hoping like hell it stays far, -far- away from number 4. I like my insurance company. I don't want them to hate me.
Whatever option, though, it looks like I'm -screwed-.
