It's just reduced their strength is all. They can still function and move like normal. They've just had their usual strong strength taken from them so they don't overpower anybody easily.
O hey, torturing prisoners. Now that's the sign of your side being the good guys if I ever seen one. Spike and Ember should be proud they helped make this happen, spreading pain to those who can't defend themselves. That is, if the story will let them know and not glance over this to keep things clean and easy for them.
To add insult to injury they should use the crystal and change garble into a pony.

Gotta say, soldiers being punished for following orders that aren't war crimes and even further ended in no actual property damage or deaths is not how these things really work. At most, Ash could be tried for breaking a treaty, and even then, this is rather minor among minor ways to break a treaty. Now Rarity's kidnapping is another matter, but again that all falls on Ash. One hundred loyal soldiers just got punished for landing on Equestrian soil, and doing not a damn thing else. In a real war, Prisoners of War are returned afterwards more often than not, and their is no standing trial for taking part in the war, only atrocities committed during such war. A small, and lets be honest not even really, invasion that they were order to do or else would almost certainly be considered insubordinate and punished, imprisoned, and/or dishonorably discharged.
9635733 At face value, no one claimed Torch to be a moral or ethical individual. Spike and Ember had no power over what happened or even a means to prevent it, happened while they were gone. Yes, he'll get away with it, but for his character I'd say it's incredibly in character. The guy maintained power through fear, strength, and intimidation even if he didn't necessarily massively abuse said power(that we know.) I assure you, he'd get away with it, too. Even if they tried to hold another court case, there's no one to really testify but a shooed away guard and Garble who I doubt would be stupid enough to say anything, if he even could.
