So I was wrongfully banned from DeviantArt today. Why? Because the artist who I credited for the cover image of Jest Your Joke DMCA'd my account. Never mind that it says right there on the rules of their page that you are allowed to alter their art and use it for your own work so long as they are credited.

All that hard work for all those years, GONE. Over one "mistake". This is absolutely wrong, I would've taken the image down had the artist hit me up and said they didn't want their image used as a cover. Having my entire account banned over this, when I clearly stated the deviation was a story with a cover that clearly credited its artist in the description is absolutely malicious.
UPDATE: I have reached out to the artist who sent the DMCA, and he apologized to me, saying it was done out of a misunderstanding. It's DA I'm upset with for making such a gross overreaction to what was clearly fair use respecting the original artist's wishes.
Welp, that's why you should always contact artist and tell them, what you are going to do with their art, even if they have "rules" or something like that on their profile.
(And, having personal message from author is always better, because "rules" can be changed, while messages stays with you and even author can't change or remove them.)

I do now regret not talking to the artist first, even though I firmly stand by the fact that I did nothing wrong. However, DA had no right to play judge, jury, and executioner before they even had my side of the story. That is totally indefensible to not just permaban me over posting a story that was mine over non-existent "copyright infringement" regarding the cover, but wipe my ENTIRE GALLERY BUILT UP FOR OVER TEN YEARS clean so that not even my fans can read my stuff anymore. So yeah, even if you want to split hairs and say I made a slight mistake, so what? You're not going to tell me with a straight face that a punishment like that is fair, right?

I'm not even sure what that means and no, that's not my point.
My point is to remind, that you always want to ask author before doing anything, and that's it. Situations like this less likely to happen, if you (not you specifically, "you" in general) ask before.

"Split hairs" means to make small, unnecessary distinctions. I also already conceded that I should've asked in confessing my regret. Are we at least in agreement that DA is in the wrong here for jumping the gun?
