Now I'm curious about something:
If in some unholy reason Rarity is actually thrown in jail, who will help protect Equestria? Rarity is the Element of Generosity and we know from the show that you need all six for it to work. So if Raritys in jail and say another attack on Equestria happens, how will they protect the land if she's in jail? The Equestrian justice system would be at fault cause they put away one of the protectors of Equestria.

Well, that's a thought that's gonna fester. I'll admit that isn't something I’d thought about at all. Perhaps, she would be permitted supervised work release? Taking a couple guards adventuring across Equestria might slow the Mane 6 down though...
A follow-up question to your question would be, what if something happens now and the Elements are needed to go galavanting? Dash is in no condition for that kind of exertion. Hmmm...

I think Rainbow's PoV is a very important part of creating that feeling. You're right, up to this point it certainly seems like Rarity is just doing all the right things and a major reason for that is that she seems to be in tune with what Dash wants and thinks she needs. However, there are a few things that Rarity is doing that may or may not be healthy for Dash. Things like taking Dash to the boutique instead of taking her to the hospital, or the concerns about codependency that Fluttershy voices in chapter 12 (which are very valid).

You are right about Rainbow. Big Mac raping her has caused her to pratically be immobile for the time being. And if Equestria somehow does get invaded or attacked before the trial the elements wouldn't be able to do much unless they get very lucky (with the track record they have it's debatable itself) or risk hurting Dash even more. Say Chrysalis or Tierk return and attack again, the elements cannot do anything to stop them cause Dash is injured. In return it would cause Dash more self guilt and all of Equestria would want Mac dead cause he couldn't keep it in his pants and raped one of Equestrias main protectors.
Good lord Spitfire is gonna have a field day when she sees how bad Dash is. But niw thinking about it.....
In Chapter 12 you (of Dash in this case) stated that a Wonderbolt is actually a active member of the military. If that is true then Mac technically raped a member of Equestrias government, which would have much HIGHER charges than first degree rape. So to sum that up:
Mac could've most likely ruined Equestria or serve extremely high jail time....... or both. How Twilight didn't know that is beyond me.

Though that could play to Rarity's defense too. She wasn't just defending Rainbow, but very likely all of Equestrian could have been destroyed if Rainbow had died during the attack.
I mean, if the lawyer will drag up all the ancient law he can for a revenge suit - because that's all this could possibly be at this point - all the more reason to hit back.
"Mister Macintosh, I'm here to recommend you drop charges against Miss Rarity, plead guilty, and beg for mercy from the courts. Because if you don't, I have a royal warrant here to arrest you for high treason."
I could see Luna pulling that one out.

Hmmmm... I'm not sure that I'd agree with the idea that Mac would receive a harsher punishment because of Dash's government connections. Even if he could receive some kind of increased penalty, Celestia maintaining her distance effectively downplays the connection anyway, which might explain why Twilight didn't factor in the potential for more aggressive consequences.
I genuinely think coming to terms with the fact that Celestia isn't coming to the rescue, even though she could, is throwing Twilight off her game in a big way at this point in the story.
Spitfire is gonna burn somepony to ash when she finds out what really happened....

Rainbow has mentioned a few times Rarity's career, but I never considered what lasting effects the attack could have on herself, and thus, on her own career.
That felt like a punch to the guts. Another one.
