Sorry, but your story takes place immediately after the latest episode, so unless Thorax waited around a decade to make this offer or Spike stepped into a time machine and had adventures with Doctor Whooves for a similar time, Spike is not a legal teenager. Twilight is just barely a legal teenager herself and she hatched him somewhere around age 6-10.
And that's fine. Spike can be underaged. In all likelihood, Thorax is not all that old himself. We saw him born and Chryssy was not looking much younger than we've seen her. Changelings likely grow at a quick rate.
Please don't make false claims just to satisfy people. Either write the time passage into the story or own up to the fact you wrote foalcon. It's okay, really.

Very well. I shall change some things abit and add a foalcon warning.
I always got confused with foalcon rules, so that's why I used the teenager spike thing.
I also used the Alternate Universe tag but screw it.
I can understand skipping the deceit angle here, but there is a point in the commencement of sexual activities where open and precise communication murders the mood.
And that point is right around "That will be 40 dollars upfront," "I'm just in it for the free meal," "I'm only doing this because I lost a bet" and "Listen, if I don't have sex in the next 10 minutes the sub-dermal explosive in my spine will detonate!"
While these are all fine and dandy motives for people to engage in sexual intercourse, actually expressing these motives to your partner, in real life or in fiction, will torpedo the mood with brutal efficiency.

7508561 well if we take into account that Twilight hatched Spike when she was a filly then it would be safe to assume that in pony years he's a legal adult or at least a teenager.
7564438 She hatched Spike when she got her cutiemark, which was, again, around age 6-10. So Spike's age is Twilight's age minus her age when she hatched him. If we assume Rainbow is now twenty one (candles on her cake) and Twilight is about two years younger, that makes Spike 9-13. He's a mature little guy, but yeah, he needs a decade before we can declare him legal.

This ain't foalcon. The idea that Spike's under 18 is just speculation. We can speculate that he's under 18. For that matter, we can speculate that any of the Mane 6 are under 18. But “foalcon” doesn't mean anyone who's maybe under-18. If it did, anything involving the Mane 6 would be foalcon! “Foalcon” means foals, children.

Well, no. The idea that he's under 18 is based on the fact that Twilight is not yet 26, and she is about 8 when she hatches him, because that's how time works. Also, in season 8, he's finally hitting dragon puberty. And, well, if he's finally hitting it then, it follows he had not hit it in season six.

Unless I'm missing something, I don't think the show's ever told us how old Twilight is, or how old she was when she hatched Spike.
As for the “dragon puberty” thing: I haven't read about about what's going to happen in Season 8. But this fanfic was written in 2016, well before any Season 8 announcements came out. In any case: Spike's a "baby" dragon, but "baby" obviously means something very different for a dragon then it does for a human or a pony (dragons do live for thousands of years after all). This “dragon puberty” probably does too.
But more to the point: You called this fic “foalcon”. When I hear “foalcon”, I think of a fanfic that tries to sexualize children. Like, one where an adult does something inappropriate to a child, and it's portrayed as something tantalizing and acceptable, rather then something horrific. Two teenage lovers being adorable (if Spike and Thorax are even teenagers) doesn't really qualify.

Bear in mind, I'm not saying there is anything wrong with foalcon, just that canon Spike is by no means an adult just yet. Twilight is just barely an adult herself and she hatched him. Add about 5-10 years to your story and yes, I can buy that, but as is, no.
As for whether two underage characters getting together is still considered foalcon, sex with a minor, even if it's with another minor, is generally how people determine what is and isn't foalcon.
