6136996 Okay, let's take a look at the question of "is Silver raping these pirate mares"?
To give a concise answer, I'd say that he is not. This is for two reasons: the first is that his pheromones do not represent any sort of undue influence over them. The second is that his offer of having them bare him a foal in lieu of going to jail is not an unlawful. Let's go over these in more detail.
With regards to Silver's pheromones, it has been established that his scent does raise the degree of lust in those around him who inhale them. This occurs regardless of the sex or sexual preference of those who are subject to it. Moreover, Celestia has given Silver an object lesson in what happens when these pheromones become too potent, as a few chapters back she thickened her own pheromones to the point where Silver felt that it was subsuming his ability to think consciously; indeed, this frightened him so badly that he used their safe-word to make her stop.
However, this latter point (e.g. Celestia's lesson that pheromones of great enough power can overwhelm a pony's conscious thought processes entirely) is not applicable here, and indeed may not be applicable to Silver at all. His pheromones have never been shown to cause another pony (or cat, or any other sentient being) to lose themselves to the point of impairing their cognition. Even when firmly aroused, those around him have still been able to keep themselves from engaging in coital activities if they didn't want to, such as with the male cat guard that Silver waved off, or Amenti when Silver likewise refused to have sex with her, or even with the one pirate mare here who refused his advances (though in that case, I do wonder - even if there's no evidence for it - if that was because Silver wasn't a member of her sexual preference). As such, we cannot say that Silver is drugging them per se.
That's a reasonable conclusion, but even if it's not "drugging" the pirate mares into accepting his advances, do his pheromones nonetheless constitute an undue influence on their decision-making process? He may not be reducing them to lust-fueled puppets, but is he still impairing their good judgment to the point where this would cross an ethical line? Here, I feel that the answer is once again "no."
The reason for that is that Silver is not wielding any particular mechanism of influence that is unique to him. The reason for that is because there's no basis for claiming that this should ever be subject to "fairness" to begin with; the same way that some ponies are going to be more attractive than others, be they taller, funnier, handsomer, etc., some are likely to have a more potent scent than others. In this regard, Silver is simply exceptionally gifted. Indeed, it is expected that this should be so, since alicorns are all-but-outright stated to be greater than non-alicorn ponies in virtually every regard. He has greater magic and greater physicality than virtually any other pony; why would be not therefore also have a greater ability to attract females (and some males) with his scent?
Moving on, we come to the issue of his magic item. Unlike the issue with Silver's "natural" abilities, this one is clearly an unnatural enhancement to his pheromones. Once again, however, we find that we cannot reasonably hold this against him. There are several reasons for this: 1) Silver is not only not wearing this of his own accord, but is unable to remove it; therefore, we cannot say that he is deliberately attempting to increase his level of ability to entreat mares that would be receptive to his advances. 2) Wearing this does not create any impetus for Silver to try and abstain from sexual activity while he has it on. That's because it does not increase his pheromones to the point where they become any sort of true "drug" (as explained above).
Moreover, he has no moral impetus not to engage in sexual activity since he did not do this to himself - he is the victim of that item, and so cannot in good conscience be victimized further by being stated to be "morally" compelled to restrain his normal, amorous advances. This times into reason 3) that the one most influenced by the item is Silver himself, since it creates unnatural lust within him when going about activities that would nor normally cause arousal (e.g. when using magic). While this doesn't mean that he's not resonsible for his actions, he is under the effects of a source of lust that, unlike pheromones, is not normally present in his day-to-day life as a pony. Seeing as how he's affected most by his item, it makes little sense to say that he's responsible for using it to unduly influence others to any sort of unethical degree.
This all brings us to the second (and final) point raised at the start of this post: is it wrong for Silver to offer to the pirate mares go free from jail (and receive some bits) if they agree to bear him a foal? Once more, the answer is a clear negative.
It's easy to characterize what Silver is doing as him essentially "pressuring" them to put out. After all, if they don't raise their tail and become impregnated by him, then they're going to go to jail (or possibly worse, depending on what the local jurisdiction hands out as criminal penalties for piracy)! That clearly pressures them to accept his advances, but is that pressure unethical? Perhaps surprisingly, it's not.
The reason for that is because, in order for the pirate mares to be said to have accepted this deal in a state of duress, the penalties being leveled against them should they refuse to take the deal must be either unlawful or improper. In this case, neither of those caveats apply. It is entirely lawful that pirates should go to jail for committing criminal acts; likewise, there's nothing improper about the penalties that they're likely to face (that we've been told so far). Moreover, as they're on an Equestrian vessel, sailing in what is likely international waters, Silver is the legal authority in the current situation (notwithstanding Celestia, who seems to have been chastised after Silver assured her that he wouldn't touch anypony that said no to him), so he's entirely within his rights to offer a deal in the first place. Indeed, this is little different than any prosecutor offering a deal in exchange for a commuted sentence.
As such, there's really no way that what Silver's doing with these pirates could be considered rape, technically or otherwise.
6137139 After several chapters of grief and sorrow, the story makes an unexpected return to form, and it's a welcome change! I honestly didn't expect the story to bring back the sexual hijinks (this soon) - or rather, I wasn't sure if it could do so in any sort of artful manner - and I'm quite pleased to have been proven wrong here. The end result was a masterful chapter that moved things back toward a state of "normalcy" (or whatever passes for that with Silver).
I should note that it was nice of the fic to open with a few paragraphs in reference, not only to the lingering sorrow that Silver and Shei felt, but also to note that time was slowly passing and that they were learning how to cope. Indeed, I was very glad for that, since that notation helped to ease the transition in tone that this chapter achieved. Unless circumstances remain terrible, or there's something wrong with them, then people simply aren't built to suffer for prolonged periods. Instead, we habituate fairly quickly, with everything becoming status quo. Hence, it was a positive change to see things moving in that direction.
That also created the pretext so as to allow the characters, and the audience, to appreciate what happened next: a pirate attack!
The existence of pirates here is interesting, since it carries some hints as to the larger state of this part of the world. For one thing, it implies that the coastal areas (since they're sailing from Anugypt to Saddle Arabia, it seems likely that they're close to land, at least compared to crossing the ocean between Anugypt and Equestria) lack any sort of strong naval military presence. In other words, the local governments either can't or won't (for whatever reason) supply a large enough series of ships to keep order and destroy of run off the pirates in the area. That speaks to the larger state of this entire area, and may hint that the local economic problems aren't just limited to Anugypt (which wouldn't be surprising, since economies tend to spread across neighboring states).
I'm also wondering just what the pirates were after. While it's tempting to think of them as simply looking for treasure (especially on what is probably an opulent-looking ship), the Barbary pirates (which I imagine these are based off of) frequently took slaves. While many of these were ransomed (a process that sometimes took years, e.g. Miguel de Cervantes), others were kept for labor, sexual uses (though that doesn't seem quite as likely here, since that pirate captain was so horrified by the thought of Silver claiming her...or maybe she was just a hypocrite), but most often they were treated like any other good, and sold off in slave-holding territories for profit. Given that both Anugypt and Saddle Arabia seem fine with Silver owning two mares, I suspect that this might be the case here.
...in fact, if that is the case for this ship, then I suspect that the sailors currently manning it might find some ponies (or cats, or Anubians, or even something else) chained up below deck. Silver may have more than just captured mares (and lustful guards) to deal with. Of course, ideally this won't be just another excuse for him to get his stud on - if there's an important prisoner below, then this could throw the politics back into the spotlight too!
Moving on, I was surprised that, during the battle scene, Silver's flaring hormones didn't seem to have much effect on the other ponies around him (save for that pirate captain). The way his arousal kept flaring higher and higher, I really thought the fighting was going to turn into an orgy. It was a little odd that he can get a few people bidding on an inn to start going at it right there, but a ship-full of sailors aren't affected? Maybe it was due to a strong breeze blowing his scent away?
Of course, the real fun came after the pirates were captured! It was great to see Silver finally start to take his studding duties seriously. This, right here, is what I've been waiting for for a while now. He's got a captive group of mares, and they're all going to stay captive until they're ready to bear him a foal (or go to jail, whichever comes first). Since there's probably a long way to go yet, he's got plenty of time until they all enter their season (though it was a bit odd that not all of them were, simply because - in the real world - women who live together tend to menstruate together; I guess ponies are different?).
I was struck by several aspects of the scene of Silver amidst the captured pirates. For one thing, they were all there in the brig while he was doing them...so he was basically rutting in front of an audience? Damn...talk about confidence! Also, I'm presuming that that one mare that refused Silver was an example of Chekhov's Gun, and that she wouldn't have been mentioned unless she was going to be brought up again later (otherwise, why mention her). Hopefully she'll get a name when she does so! I'm presuming that she's a lesbian, and so isn't really interested in him no matter how sexy he smells, but at the same time, that's a rather simplistic explanation. I look forward to finding out either way. Of course, the real prize is the captain herself...how long can she hold out?
Plus, it was nice to see Silver tell Celestia off. I've already spoken with regards to whether or not I think Silver is raping those guards, so I won't mention it again here, but I'm not sure why Silver was suddenly pissed at Celestia when she told him not to rape. Was he just really insulted, or was it a visceral reaction to her perceived cock-blocking him? I'm trying not to read too much into it, but the source of his sudden, brief anger isn't clear.
Either way, it's great to see Silver back in top form! And just wait until Luna hears about what her warrior-husband is doing.
6137456 Celestia was being a low-scale hypocrite. She merrily ripped his masculinity away and said he should get pregnant, fat, and happy, and it'd straighten him out. The idea that she of all ponies would stop him from making a bunch of outlaws pregnant, fat, and happy was too much at the moment, and he told her off before going about his business.
She's likely to raise a fuss again later, mind. It does not sit right with her, and it doesn't feel in character that she wouldn't give another try or two to dissuade him.
For his part, he was deep in male rut, and he rode it for all it was worth, barring the moment he almost experienced a gelding via angry mare teeth. If the pirate mares act kindly towards him afterwards, they'll find him a kind stud in return, and he'll do his best to make sure they are situated when they arrive, even if he is ending their current career.
The one that went at him without being in season was a bit of a challenge. He does still feel randomly engaging in shenanigans without trying to make foals is a bit cheating.

This is seen all over the place, cutting a deal so not having to go to jail, and silver already said they would be getting money and help from the state as well. It isn't he fucks them, then throws them overboard. So I agree, that is not wrong mostly.
However, I still believe that his pheromones were very influencal. It was enough were a Guard. OUTSIDE. Was effected by it to wanted to be fucked senseless by him.
We know Silver's pheromones and his lust grows with his use of magic, and he used a lot of it. Also as far as we know, not much time if any had past at all, less than 10 mins for all we know from using all that magic, and walking into the room with them all.

Don't know about you, But I am pretty that even if you rape someone, and during it they ended up liking it, at the end it would STILL be rape. And for all we know it was his pheromones and the act itself causing all of this, clouding her mind from saying no.
The final thing is:
This pretty much states that his pheromones are powerful enough to make someone want to be fucked by him no matter the reason.
If his pheromones weren't that high from using all that magic before hand? Probably nothing would have happened. But they were strong enough for someone to lift there tail, he fucks that person without her even agreeing. In fact, not even seconds earlier she was "She shuddered at his attention. "Ye can't make me!"". But while fucking her, the pheromones work into her and makes her like the sex. Then he leaves, yet there is still enough strong pheromones that even a guard outside of the room gets bold enough to walk up to the god/prince/ruler and asks him to bred her silly.
How can none of that be seen as rapey, or wrong morally or otherwise? After all, it was very heavily implied that the pheromones were influencing the pirates. I mean, he pretty much did the same thing he did to the pirate as he did with Aila, only without the pheromones, and that was still rape too. Why is this different, when there are pheromones involved and they are criminals?
6138141 I try to avoid weighing in on these issues, but for what it's worth? I'm pretty sure Silver would be found guilty in a modern court of law without too much undue effort for a few things he's done, as soon as they could prove what he's doing.
Me, as a person, do not think this is a morally clear and upright thing to do, but my opinion doesn't count for much. I just write what I 'see', and give the occasional little nudge to keep things on track. I do think if you had to lose to someone in a theoretical fight to the death, there are worse options out there, but that doesn't make it the right option.

Except for the "mostly" at the end of your last sentence, I concur.
To be clear, it would be wrong in any contemporary Western court for a prosecutor to trade a reduced sentence for sexual favors, but that's a specificity - with regards to the legalities and morality of this time and place, as opposed to Equestria in this story - of what a prosecutor can offer in exchange for (what is essentially) a guilty plea. It doesn't change the fact that Silver is in a position to legally and ethically offer such a deal to begin with.
There's no denying that the pheromones were influential, potentially very much so. But the question is whether or not that's enough to impair their judgment to the degree that Silver was impinging on their ability to give informed consent. In that regard, I don't think that it was.
The fact that they were potent enough to sway a guard isn't a relevant factor. We know that his scent is just that delectable to anyone that'd find him attractive. But again, this isn't anything that any other pony doesn't have themselves, if not to such a powerful degree.
This is where you start to lose me. "He used a lot of it"? Did he? Looking back, he used one "powerful burst" of magic on a pirate that tried to subdue him. This was apparently so powerful that it...knocked that pirate onto his haunches (e.g. into a sitting position). Needless to say, that doesn't seem that powerful.
Other than that, he used three instances of telekinetically lifting something; once to grab a sword, once in a failed attempt to grab the pirate captain's sword, and once to lift her up before she could retreat. Given what we've seen Silver do, and what we know an alicorn - even a nascent one - can do, this really doesn't seem like very much.
But the thing is, that's all beside the point. We're not debating how much magic - and therefore pheromones - he was manifesting when he was in there. We're debating if it was enough to erode those mares' ability to make an informed, conscious decision about whether or not they wanted to have sex with him, and in that regard I don't think this speaks to that.
Here, you're suggesting that Silver wasn't sure if his pheromones were influencing her or not. Again, I believe that's the wrong question to ask - they clearly were influencing her. The real question is if this influence is undue or not.
The reason that's such a central question, at least for me, is that it's important to remember the context that this is set against. All ponies have pheromones, which they cannot help but radiate when they're aroused (for stallions) or in their season (for females). Indeed, females can even buy perfume that smells identical to their pheromones. If something is entirely natural, cannot be turned off (barring extraordinary measures, such as slathering one's self with another scent to mask the pheromones), and ubiquitous to all members of a given species, it cannot be considered undue.
This is vital to remember, because it reminds us that we can't take Silver's powerful pheromones in isolation. True, his are more potent than most other stallions, but that's not something that can be held against him, any more than we can help that some people are better-looking than others simply because of how their face is shaped, etc. Moreover, these mares have been subjected to stallion pheromones their entire lives; they are not unaware of what's happening.
In fact, recall that Silver is consciously aware of the scent of those mares that are fertile - the opposite is true as well (something we can confirm from when Silver was a female, and swooning over Flash Sentry). These mares know that he has pheromones, and powerful ones at that; they're consciously aware of it, rather than not knowing why they feel the way they do.
Finally, the mare in the example you quoted did give her consent; she just didn't do it verbally. Her raising her tail for him was a conscious and deliberate action on her part, and was clearly understood to give her consent to Silver's having sex with her.
I believe you're misreading this passage; what I took from the quoted text was that it was speaking with regards to her state of mind insofar as satisfying that nebulous clause about the mare needing to feel "love" in order to become impregnated. I don't think that this was with regards to her consent to having sex with Silver.
Even if it is, however, the point is entirely moot. This is the same mare that you quoted in your previous example, and as I noted in response to that, she did give her consent (via raising her tail). She may not have liked doing it, but she did still knowingly and willingly do so, and without any unlawful or improper coercion on Silver's part, nor did he expose her to any "drugs" (e.g. pheromones) that she wasn't aware of or had not encountered countless times before. Ergo, he is not raping her. Her mind is not "clouded."
I disagree; that's not at all what it says. It says that his pheromones can affect how enjoyable they find the sex they're having with him - that's all. Once again I'll note that this is the same mare from your first two examples, who has already voluntarily agreed to sex with Silver, as per the conditions I outlined in my response to your second example.

You've also misstated that the mare in question was someone that Silver had sex with "without her agreeing." If we want to go that route, there are multiple reasons why he'd never even be subject to our criminal justice system to begin with - even if he were, the nature of trying to apply our laws to alien creatures, in a foreign land, with their morals and ethics that are tailored to those differences (unlike our own) would make any such attempt a kangaroo court at best.
Pheromones are not date-rape drugs. To treat them like they are is to wildly misunderstand the situation, especially when everyone has them, knows about them, and have been exposed to them with regularity.
Insofar as his coercive attempts to gain sex in exchange for letting them out of jail, I've already mentioned that he's in a position to do that, legally. Morally, we may find it repugnant, but that's based around our own views of how sex "should" be - it's clearly different in the scenario described.
