1696469 There's such a thing as creative liberties as well as cease and desist. It is legal to sell and profit but not legal if they order a cease and desist. It's the same thing as artists making money off making Pony artwork or posters and such.
Plus, the people that put the "MLP isn't owned by me and this is in no way associated as it is merely a fanwork" or disclaimer like that automatically give up their creative commons freedoms and forfeit ownership to the company.
tl;dr, I can sell it AND profit as long as I don't claim everything to be my own creation and as long as the company doesn't tell me to stop.
