Hmmm funnily enough I remember from my one philosophy course (my college required you to take at least one course in 8 separate fields) that probably the one crime you could never get rid of the death penalty for is treason, simply because those who commit treason already don't care for the power of law. Sadly it's been a half decade now so I can't remember who it was that said that.
In any case though I'd probably take a third option in this situation once the guilt of pro Sombran elements was confirmed, sentence all to execution, but then as they approach the gallows grant a reprieve for select members of that group who either committed lesser crimes in support of Sombra or were honestly remorseful (if that could be figured out) and leaving them to the prisons, while still executing the rottenest eggs of the bunch. During the Winter of 1781 during the American Revolution their were 8 soldiers who were scheduled to be executed for an attempted mutiny. Washington granted a reprieve for 7 of them before the firing squad opened up on them, the 8th was filled with lead...

I'm not sure if that's the case. I think it's more a show of a lack of loyalty towards where you belong. The problem with that is that real trust can never truly be regained. Also with treason you can only hand out punishment when the damage is already done.
7193718 I don't believe in that idea but I hope you make it less overtly sexual. That's consistently your biggest flaw. Also if you're going for a therapeutic idea you need to include therapeutic elements in it. For example have Shining use Cadance's fear to force the answers out of her.
I think some crystal ponies would hold some resentment against Shining because of his close connection to equestria's royal authority. He was captain of the royal guard and he's the brother of the princess' student. Because of the empire's confusing relationship with equestria the views on Celestia would be mixed and that would also be portrayed onto him.
